1. Acceptance of Terms

By accessing or using Viral Engine ("Service"), operated by Status Digital Marketing LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Viral Engine is an AI-powered creative automation platform that enables users to generate images, videos, ad variations, and marketing content using artificial intelligence. The Service is provided on a subscription and credit-based model.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current registration information

4. Subscription Plans and Credits

• The Service offers multiple subscription tiers, each providing a monthly credit allocation.
• Credits are consumed when generating images, videos, or other AI content.
• Unused credits do not roll over to the next billing cycle unless otherwise stated.
• New accounts receive a one-time allocation of free credits.
• Subscription fees are billed in advance on a monthly or annual basis through Stripe.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create deepfakes or misleading content designed to deceive or defraud
• Violate any applicable local, state, national, or international law
• Infringe on intellectual property rights of third parties
• Attempt to reverse-engineer, decompile, or exploit the Service
• Share account credentials or resell access without authorization
• Overload or interfere with the Service's infrastructure

6. Content Ownership and License

• Your Input: You retain ownership of any images, text, or other materials you upload to the Service.
• Generated Content: Subject to the terms of the underlying AI model providers, you own the outputs generated through the Service for your commercial or personal use.
• License to Us: You grant us a limited, non-exclusive license to process your inputs solely for the purpose of providing the Service.
• No Guarantees: AI-generated content may not be eligible for copyright protection in all jurisdictions. You are responsible for verifying usage rights.

7. Third-Party Services

The Service integrates with third-party AI providers (including but not limited to Google, OpenAI, and PiAPI). Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability or performance of third-party services.

8. Payment and Refunds

• All payments are processed securely via Stripe.
• Subscriptions auto-renew unless cancelled before the next billing cycle.
• You may cancel your subscription at any time; access continues until the end of the current billing period.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss resulting from downtime.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New Jersey.
